15. 26-123 Proposed Ordinance to Amend Open Burning Regulations. To receive public comment on its intent to adopt an ordinance to amend County Code Chapter 6, Fire Protection, Burning of brush, etc. The proposed ordinance would amend Article IV, Regulation of Open Burning, to include updating the definition of bonfire and requirements related to a bonfire, adding definitions for building and structure, and clarifying the definition of recreational open burning, adding escalating penalties for repeated offenses, and adding language that the Albemarle County Fire Official can ban burning based on weather, atmospheric conditions or local circumstances making such fires hazardous. All proposed amendments would be enabled by Virginia Code §10.1-1142, §15.2-922.1, §15.2-1429, §27-98, and §44-146.21 to be effective on and after February 1, 2026.
