PROJECT: SP201900006 Boyd Tavern Market MAGISTERIAL DISTRICT: Scottsville TAX MAP/PARCEL: 09400-00-00-03900 LOCATION: Parcel located approximately 200 feet southwest from the intersection of State Route 616 (Black Cat Road) and Mechunk Road. Parcel has frontage along State Route 616. The northern portion of the parcel is adjacent to the I-64 interchange at Exit 129. PROPOSAL: Proposal for new 4,000 square foot gross-floor-area-maximum auto service station with five fuel pumps under two canopies, convenience store and restaurant on the approx. 3.28-acre portion of the site that is zoned C-1 Commercial and fronts on State Route 616 (Black Cat Road). PETITION: Automobile service station, convenience store, and restaurant per Zoning Ordinance 18-22.2.2(16)(a)(b)(c) on an approx. 3.28 acre portion of a parcel totaling 12.486 acres. No dwelling units are proposed. ZONING: This parcel is zoned both: RA Rural Area - agricultural, forestal, and fishery uses; residential density (0.5 unit/acre in development lots); and C-1 Commercial - retail sales and service; residential by special use permit (15 units/ acre). OVERLAY DISTRICT(S): Entrance Corridor; Steep Slopes - Critical COMPREHENSIVE PLAN: Rural Area - preserve and protect agricultural, forestal, open space, and natural, historic and scenic resources; residential (0.5 unit/ acre in development lots). POTENTIALLY IN MONTICELLO VIEWSHED: Yes.

    As a Black Cat Road resident, I have many concerns with this potential project.
    - My major concern is road/traffic safety. In the 3 years that I have lived here, I have lost 6 mailboxes and 30ft of fencing to reckless drivers. If a gas station is built, it’s safe to assume that traffic will increase, and inevitably so will dangerous drivers and, therefore, so will the encroachments into our yard.
    - Trash is dumped all along black cat road already, and with a gas station next door, the trash will increase significantly. BUt picking up trash in my yard is dangerous, as many cars drive off the road.
    - Just like my neighbors, I am concerned with the water and well situation.
    - I would be neighbors with this gas station. I bought a nice house with land, in a quiet area - I did not want to live next to a gas station.

    Concerns are...

    Water usage
    Traffic
    Safety
    Litter
    Light/Noise Pollution

    How many of these Convenience Stores does Tiger Fuel need in Albe Co? Will there be requests for More and More? With this opposition from locals, does this Undertaking by Tiger Fuel Equate to a True Friend of Albemarle Co and Keswick Residents...I think Not!!!

    This is a Project that the Vast Majority of Local Residents are overwhelmingly against!

    I hope the BOS is able to appreciate our wishes (We the people...as I recall...a Govt of the People, by the People and for the People) and make the RIGHT Decision in this case for the local population of Keswick and Troy!!

    I find it interesting that people suddenly in favor of this SUP do not live in the Boyd Tavern Community, nor will their lives be impacted daily by this 4000 square foot interstate market! Their support is NOT based upon research and facts, but rather on "feel good" platitudes, as they list no facts among their elements of support. They do not own nearby homes that will be devalued, their groundwater source threatened, or be subjected to increased noise, litter, lighting, crime, benzene pollution, and other deleterious factors associated with this community invasion. Why do they not support their own neighborhood c-stores as most live within minutes of one? Their lives will go on as before, but not those of the Boyd Tavern Community. They did not attend and/or speak at the Planning Commission Hearing, but now they suddenly have a voice. So, what has changed?

    I'm a Keswick local and would love to see a market built right down the road from where I live. I grew up in Charlottesville and think the Tiger Fuel co. has served our area well! The location makes sense and would be a great way to support the local community.

    I completely oppose the installation of a Automobile service station at the exit 129 off of US 64. I am concerned that this station will dramatically increase the noise, traffic and over burden our ground water supply.

    We fully support the Boyd Tavern Project! Tiger Fuel is a great company who has been in the Charlottesville area for many years and fully support the community! This location would be a great addition for the local community as well as those traveling through the area. The Market would be convenient for those living in the area and would provide them with an alternative to having to travel to Charlottesville for many items.

    How can a 4000+ squared foot Market open 17 hours per day, with 10 gasoline nozzles, situated on an acre of impervious concrete and asphalt, with a VDOT AADT of over 54000 be considered a rural
    Market? The comparables used by Tiger Fuel
    are not comparable in that all are miles removed from any interstate. The Tier III groundwater assessment lacks specifics and any corroborating scientific evidence and is statistically unreliable. It was never validated by a qualified hydrologist and contains conflicting information with a Tier III study on an adjacent parcel just across route 250 in 2008 by the same author. Dr. Evans in the Tiger Fuel study calculates groundwater recharge on the entire 3.28 acres. How can recharge occur on 3.28 acres when close to an acre will be covered with an impervious surface? Additionally, groundwater recharge calculations in the Virginia piedmont are among the most difficult metrics to calculate. This fact is supported by several hydrologists at DEQ and USGS.
